R. F Greasby Auctioneers Terms of Service

1. The Auctioneers act solely as agents for the seller and are not liable for any default by either the seller or the buyer.

2. The seller warrants to the Auctioneers and to the buyer that they are either the true owner of the lot or properly authorized to sell it on behalf of the true owner, and that they can transfer clear and marketable title to the lot, free of any third-party claims. The seller agrees to indemnify the Auctioneers, their employees, agents, and the buyer against any loss, damage, or liability resulting from any breach of this warranty, including all costs and expenses incurred by the Auctioneers in addressing any such claims.

- (a) All statements in catalogues, advertisements, or brochures about the following points (specified in (b) and (c) below) are expressions of opinion only and should not be taken as factual representations. Illustrations in these materials are for buyer guidance and may not accurately convey tone, color, or imperfections in any lot. Prospective buyers are encouraged to satisfy themselves about these details, including physical descriptions and the condition of lots, through inspection or other means.

- (b) Neither the seller nor the Auctioneers are liable for the accuracy of any statement regarding the authorship, origin, date, age, attribution, genuineness, or provenance of any lot, or any other descriptive aspects.

- (c) Neither the seller nor the Auctioneers are responsible for any faults or defects in any lot.

- (d) Neither the seller nor the Auctioneers, nor any of their employees, are authorized to make any representations or warranties, nor are they liable for any representations, warranties, or statements in catalogues, advertisements, brochures, or illustrations.

4. The Auctioneers reserve the right to deny entry to the premises or attendance at their auctions to any individual at their sole discretion.

- (a) Children under 16 are not permitted on the premises.

5. The Auctioneers have absolute discretion, without explanation, to refuse any bid, to divide any lot, to combine multiple lots, to withdraw any lot from the auction, and, in the event of a dispute, to put any lot up for auction again.

6. Before the auction, the seller may set a reserve price on any lot. This reserve cannot be changed without the Auctioneers’ consent. If a reserve price is set, only the Auctioneers may bid on behalf of the seller. If no reserve is set, the seller may bid either personally or through an authorized agent.

7. Any disputes over bids will be resolved at the Auctioneers' absolute discretion. Every bidder is presumed to be acting as a principal unless a written acknowledgment is in place indicating they are acting as an agent for a named principal.

8. The highest bid acceptable to the Auctioneers will secure the lot. If a dispute arises during or immediately after the sale, the Auctioneer may at their discretion either re-offer the lot for sale or serve as the sole arbitrator in resolving the dispute. Their decision is final and binding.

9. A buyer’s commission of 23% will be added to all successful bids, except for vehicles, where a 12% commission applies unless otherwise noted. VAT will be applied to the commission only unless specified otherwise.

10. The purchaser must provide their name, address, and, if requested, bank or other suitable references to the Auctioneers. They may also be required to pay all or part of the purchase price immediately. If they fail to do so, the Auctioneers may, at their discretion, re-sell the lot.

11. No lot may be transferred or removed during the sale, and the purchase price must be paid in full before removing any lot.

12. Buyers must pay for and collect their purchases at their own expense and risk as soon as possible, but no later than 4:45 PM on the day following the sale. Items not paid for or collected by this deadline will incur a £5 per lot per day storage fee plus administration costs. After 14 days, items may be resold, and the deposit will be applied against all costs; the buyer forfeits their purchase rights. If the resale proceeds are insufficient to cover the original purchase price and all other expenses, the purchaser must pay the remaining balance at the company’s discretion.

13. If the Auctioneers store any lot, either on their premises or elsewhere, it will be at the purchaser’s sole expense, and the lot will only be released upon full payment of the purchase price and any accrued removal, storage, and insurance costs. The Auctioneers may also charge interest on overdue amounts at 2% above Barclays Bank's base rate.

14. Ownership of a lot passes to the purchaser only upon full payment. However, risk transfers to the purchaser immediately upon the fall of the hammer. The Auctioneers have a lien on any sold lot until full payment is received and may forfeit any deposit paid as part of the purchase.

15. The purchaser is responsible for any damage to the premises or any lot caused by them. After the specified period in Clause 12, the Auctioneers and their employees bear no liability for loss or damage to any lot, even if due to negligence.

16. The seller authorizes the Auctioneers to deduct commission from the purchase price.

17. The Auctioneers will remit the sale proceeds to the seller within one month of the auction date.

18. If a seller cancels a sale, the Auctioneers may charge a fee of 10% of the latest auction estimate for the withdrawn property, plus VAT and storage fees.

19. If a lot does not sell, the Auctioneers will notify the seller. The seller may choose to re-offer the lot or collect it, in which case a 7.5% commission on the reserve price is payable. If no arrangements are made:

- (i) Within seven working days, the seller is liable for any removal, storage, and insurance fees.

- (ii) Within three months, the Auctioneers may sell the lot at public auction without reserve, deducting any sums owed, including fees from the first and second auctions and all other related costs, before remitting the balance to the seller.

20. We cannot guarantee that airtime providers will activate any mobile phones purchased at auction.
